General Terms and Conditions
Country hotel Can Davero

- 1 – Scope of application
These General Terms and Conditions (hereinafter “GTC”) apply to all contracts between the Landhotel Can Davero (hereinafter “Hotel”) and the guest or organizer (hereinafter “Guest”) for the provision of hotel rooms for accommodation and all related services of the Hotel. They apply in particular to:
- Room bookings (individual guests and travel groups)
- Group bookings
- Retreats and seminars
- Weddings and events
- Gastronomic services
- Additional services (e.g. massages, transfers)
Subletting or re-letting of the hotel rooms or areas provided to third parties is only permitted with the prior written consent of the hotel. Deviating general terms and conditions of the guest shall not apply unless the hotel expressly agrees to their validity in writing.

- 3 – Conclusion of contract and booking confirmation
The accommodation contract is concluded by the guest’s booking request and the hotel’s written confirmation. Offers made by the hotel are subject to change and non-binding until confirmed in writing by the hotel. A verbal or telephone booking request only becomes binding upon receipt of the written hotel confirmation.
The hotel is entitled to refuse booking requests without giving reasons. Upon conclusion of the contract, the guest recognizes these GTC as binding.
- 4 – Scope of services
4.1 Services included in the room rate
Unless expressly agreed otherwise, the following services are included in the room rate:
- Overnight stay
- Breakfast
- Use of the outdoor pool
- Use of the sauna
- WLAN (free internet access)
- Parking lot on the hotel grounds
4.2 Separately invoiced services
The following services are not included in the room rate and will be charged separately:
- Dinner (on selected evenings; availability on request)
- Drinks (incl. wine, beer, soft drinks, water)
- Massages and wellness treatments
- Statutory tourism tax of the Balearic Islands (Impost de Turisme Sostenible – ITS)
- Statutory value added tax (IVA) according to the current Spanish tax rate
- Extra beds (on request and subject to availability)
- Dog flat rate
- 5 – Prices and taxes
5.1 Room rates
The following accommodation prices apply (approximate values, subject to seasonal adjustments):

5.2 Taxes and duties
All prices quoted are subject to the statutory Spanish value added tax (IVA) at the applicable rate. In addition, the statutory tourism tax of the Balearic Islands (Impost de Turisme Sostenible) will be charged. This is payable per person per night and will be charged by the hotel in accordance with the applicable statutory provisions.
The hotel expressly reserves the right to change prices. Price adjustments do not apply to bookings that have already been confirmed in writing, unless statutory tax or duty increases make an adjustment necessary.
- 6 – Advance payment and security deposit
6.1 Individual bookings
For bookings by individual guests, a deposit of 30% of the total booking amount is due within 7 days of booking confirmation. The remaining amount must be paid on arrival at the latest.
6.2 Groups, retreats and weddings
The following deposit regulations apply to group, retreat and wedding bookings:
- Deposit: 50% of the total amount upon conclusion of the contract
- Final payment: no later than 30 days before the agreed arrival date
The hotel reserves the right to request an additional deposit or security deposit for larger groups or special events. The amount of this will be agreed individually and refunded without deductions in the event of a proper stay.
- 7 – Terms of payment
The hotel accepts the following means of payment:
- Credit card: Maestro, Mastercard, VISA, American Express
- Bank transfer
- Cash payment
Invoices are payable in full within 7 days of invoicing. In the event of late payment, the hotel is entitled to charge interest on arrears at the statutory rate in accordance with Spanish law (currently 3% above the prime rate). Further claims for damages are expressly reserved.
- 8 – Cancellation conditions
8.1 Individual bookings
Cancellations of room reservations are only effective in written form (by e-mail or registered letter). The date on which the hotel receives the written cancellation is decisive. The following cancellation deadlines apply:

Recommendation: The hotel recommends that all guests take out travel cancellation insurance in order to be covered in the event of unforeseen circumstances.
8.2 Groups, retreats and weddings (excluding bookings)
For exclusive group, retreat and wedding bookings, the following cancellation policy applies. Cancellations must be made in writing only:

The date on which the hotel receives the written notice of cancellation shall be decisive for the time of cancellation.
- 9 – No-Show
If the guest does not show up on the agreed arrival date and no prior written cancellation has been received, the hotel is entitled to charge 100% of the agreed booking amount. The booked room will be reallocated after a reasonable waiting period, but no later than 20:00 on the date of arrival, unless the guest notifies the hotel in writing.
- 10 – Cancellation by the hotel
The hotel is entitled to withdraw from the accommodation contract if there is an important reason. Good cause shall include in particular
- Force majeure (e.g. natural disasters, pandemics, earthquakes, official prohibitions or orders)
- Serious technical damage that makes proper hotel operation impossible
- Illness or absence of essential parts of the hotel staff
- Failure to make the agreed down payment within the set payment deadline
- Inappropriate or non-contractual behavior of the guest prior to arrival
- Knowingly providing false information about the guest, the purpose of the stay or the planned event
In the event of a justified withdrawal, any advance payments already made will be refunded in full. Claims for damages by the guest against the hotel shall not arise from such a withdrawal, unless the hotel has acted with intent or gross negligence.
- 11 – Check-in and check-out
Check-in: from 15:00
Check-out: until 11:00 am
Earlier check-in or later check-out (late check-out) is only possible by prior arrangement and subject to availability. The hotel is entitled to charge a separate surcharge for this. Rooms not vacated after the agreed check-out time entitle the hotel to charge for an additional night.
- 12 – House rules and rules of conduct
12.1 General rules of conduct
Guests are obliged to observe the house rules and to behave in a respectful and considerate manner towards other guests, hotel staff and hotel property. The following is binding:
- Smoking ban: Smoking is strictly prohibited in all indoor areas, especially in the rooms. In the event of non-compliance, the hotel is entitled to charge a special cleaning fee.
- Rest periods: Quiet hours apply daily from 22:00 to 08:00. Disturbing noise during this time is prohibited.
- Respectful treatment: Polite and respectful treatment of all persons on the hotel premises must be observed at all times.
- External food and beverages: The bringing in and consumption of externally purchased food and beverages in the hotel or on the hotel grounds (pool, restaurant, terrace, etc.) requires the prior consent of the hotel.
- Pool use: Use of the pool and sauna is at your own risk. Children may only enter the pool area when accompanied by a supervising adult.
12.2 Dogs and pets
Dogs are welcome at the Can Davero country hotel, provided the following conditions are met:
- Dogs must be registered in advance when booking and require the express permission of the hotel.
- A one-off cleaning fee of € 30.00 is charged for each dog brought along.
- Dogs must be kept on a lead at all times throughout the hotel grounds.
- Dogs may not be left unattended in the room or on the hotel grounds.
- The dog owner is personally liable without limitation for all damage caused by the dog to the hotel property or to third parties.
- Dogs are only allowed in the restaurant and pool areas with the express permission of the hotel.
12.3 Delivery services and external service providers
The delivery of external food and beverages to the hotel premises and the commissioning of external service providers (e.g. DJs, photographers, external masseurs, decoration) requires the prior written consent of the hotel. The hotel is entitled to refuse consent without giving reasons. The guest is liable to the hotel for any damage caused by external service providers.
- 13 – Liability of the hotel
The hotel shall only be liable for damages incurred by the guest insofar as these are based on intentional or grossly negligent behavior on the part of the hotel, its legal representatives or vicarious agents. Otherwise, the hotel’s liability is excluded to the extent permitted by law.
In particular, the hotel accepts no liability for:
- Loss, theft or damage to valuables, cash, jewelry or other personal belongings of the guest, unless these were stored in the hotel safe.
- Theft, damage to property or other damage to vehicles parked in the hotel parking lot or on the premises.
- Damage caused by third parties, fellow guests or force majeure.
The use of all hotel facilities (pool, sauna, sports facilities, etc.) is at the guest’s own risk. The hotel recommends that all guests take out travel and liability insurance.
- 14 – Liability of the guest for damages
The guest is liable for all damage caused by him/herself, accompanying persons, animals brought along or external service providers commissioned by him/her to hotel property, inventory or third parties. Damage must be reported immediately to the hotel staff. The hotel is entitled to charge the guest directly for any damage caused and – if necessary – to take legal action.
- 15 – Data protection
The hotel processes the guest’s personal data exclusively for the purpose of executing the accommodation contract and to fulfill legal obligations (e.g. reporting obligations under Spanish law). The processing is carried out on the basis of the General Data Protection Regulation (GDPR) and the applicable Spanish data protection law.

- 16 – Severability clause
Should individual provisions of these GTC be or become invalid or unenforceable in whole or in part, this shall not affect the validity of the remaining provisions. The invalid provision shall be deemed to be replaced by a provision that comes closest to the economic sense and purpose of the invalid provision and is legally effective.
- 17 – Applicable law and place of jurisdiction
All legal relationships between the hotel and the guest shall be governed exclusively by Spanish law to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG) and private international law.
The place of jurisdiction and place of performance for all disputes arising from or in connection with the accommodation contract is Palma de Mallorca, Spain, insofar as this can be legally agreed. For consumers residing in the European Union, the mandatory protective provisions of the consumer law of their respective country of residence shall continue to apply unaffected by this.
EU dispute resolution: The European Commission provides a platform for online dispute resolution (OS): https://ec.europa.eu/consumers/odr/. The hotel is not obliged or willing to participate in a dispute resolution procedure before a consumer arbitration board.
